1. Purpose of Practice Direction
Pursuant to s 334(9) of the Health (Miscellaneous Provisions) Act 1911 (the Health Act) and s 20(1)(d) of the Children's Court of Western Australia Act 1988 (the Children's Court Act) an application could be made to the Children's Court by a dependant minor.
Section 334 of the Health Act and s 20(1)(d) of the Children's Court Act are repealed by the Abortion Legislation Reform Act 2023 which commences operation on 27 March 2024.
The effect of the repeal is to abolish the non-criminal jurisdiction of the Children's Court under the Health Act.
2. Revocation of Practice Direction
Practice Direction 8 of 2022 - Health (Miscellaneous Provisions) Act 1911 - s 334(9) - Health Act Proceedings - is revoked from 27 March 2024.
The Children's Court will not accept dependant minor applications for lodgment after 2pm on 25 March 2024 as applications after that time will not be able to be determined before the repeal of the jurisdiction.
