1. Application of Practice Direction
This Practice Direction applies to a transcript of proceedings provided by the Court in accordance with s 51A of the Children's Court of Western Australia Act 1988.
This Practice Direction has effect from 12 June 2023.
2. Transcript by email
Any transcript provided by the Court will be delivered by email unless:
- the person requesting the transcript does not have access to an email address; or
- the Court agrees to a paper transcript being made available.
3. Confidentiality
A recipient of a Children's Court transcript should ensure that they comply with the confidentiality provisions of the Children and Community Services Act 2004, the Children's Court of Western Australia Act 1988 (in particular, s 35 and s 36) and the Young Offenders Act 1994.
Transcripts are provided on the basis that they are to remain in the possession of the person requesting the transcript, and are not to be shown, copied or circulated to any other person without leave of the Court, except to a party to whom the proceedings relate or their lawyer.
