Practice Direction 7 of 2023 - Interstate legal practitioners

1. Application of Practice Direction

This Practice Direction applies to a legal practitioner who holds an interstate practising certificate (interstate legal practitioner) and is instructed to appear in the Children's Court of Western Australia.

This Practice Direction has effect from 6 November 2023.

2. Interstate legal practitioner - Legal Practice Board requirements

An interstate legal practitioner who is instructed to appear in the Children's Court of Western Australia must comply with the requirements of the Legal Practice Board of Western Australia (website: www.lpbwa.org.au or telephone: 08 6211 3600).

As a matter of courtesy, an interstate legal practitioner is to inform the Court before any appearance that the practitioner holds an interstate practising certificate.

3. Appearance - in person

Any appearance in the Children's Court by an interstate legal practitioner must be made in person.

The Court will not allow an appearance by an interstate legal practitioner by audio or video link.

If an interstate legal practitioner is not able to appear in Court in person, they must brief another legal practitioner to appear in their place with full instructions.

4. Compliance with WA laws and practice

An interstate legal practitioner who appears in the Children's Court must be familiar with and comply with all laws and practice requirements applicable in Western Australia.
